NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY.
YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY
DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE LITTLE FARM, INC. USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE
THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM THE LITTLE FARM, INC. IN A LAWSUIT FOR ANY
PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO ENTER THE PROPERTY, AND THE LITTLE FARM, INC. HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT AGREE TO THIS FORM.

PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO ENTER THE PROPERTY, AND THE LITTLE FARM, INC. HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT AGREE TO THIS FORM.
I, individually and/or as parent/legal guardian (and participant, if applicable) (hereinafter sometimes referred to as “the Guest”), hereby acknowledges to The Little Farm, Inc. that I desire and/or allow my child (including dependent, ward, other guest under Guest’s care) to engage in all activities related to being at The Little Farm.
In consideration for allowing me or my child (including dependent, ward, guest, other) to participate at The Little Farm, I hereby freely and voluntarily, without duress, execute this Agreement under the following terms:
- I am actively aware of the risk(s) of participating in any activity conducted by The Little Farm, Inc. on or off the physical farm and around livestock, which includes goats, sheep, cows, pigs, horses, rabbits, geese, ducks, turkeys, chickens, cats, dogs, and any other animal on The Little Farm, Inc. property.
- I am actively aware of the inherent risk(s) of participating in a tour of the Apiary conducted by The Little Farm, Inc. on the physical farm and around bees.
- I assume all foregoing risk of using The Little Farm, Inc. property, and accept personal responsibility for damages from my use, including, but not limited to injury, disability, or death.
- I release, waive, and discharge The Little Farm, Inc., its owners, agents, employees, guides, shareholders, directors, officers, affiliates, successors, heirs, assigns, and insurance carriers (hereinafter collectively referred to as “The Little Farm”) from any and all liability to me, my heirs, and next of kin for any and all claims, demands, losses, or damages of whatever kind or nature, either in law or equity, which arise or may hereafter arise from me or my child’s visit at The Little Farm property.
- I understand and acknowledge that this waiver and release discharges The Little Farm from any liability or claim that I or my child, dependent, ward, or other under Guest’s care may have against The Little Farm that may result from my activities and time spent at The Little Farm, including but not limited to: bodily injury, illness, death, or property damage.
- I also understand that The Little Farm does not assume any responsibility or obligation to provide financial assistance or other assistance to me, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.
- I hereby release and forever discharge The Little Farm from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered to me or my child (including dependent, ward, guest, others) in connection with an emergency during their time at The Little Farm.
- I understand that me and/or my child’s time at The Little Farm may include activities that may be hazardous, including, but not limited to, animal interactions, farm games, activities, portable restroom use, interaction with other guests and/or staff that maybe infected by COVID-19 or any other sickness. I hereby expressly and specifically assume the risk of injury or harm to me or my child (or ward, dependent, guest, others) in these activities and release The Little Farm.
- If I, or anyone on my behalf makes a claim against The Little Farm related to me or my child (ward, dependent, or guests under my care) activities and time at The Little Farm, I agree to defend, indemnify, and hold harmless The Little Farm from any claim, including without limitation, loss, liability, damage, or defense cost(s) (pre- and post-suit, and through all appellate levels) which may occur as a result of any such claim. Additionally, the prevailing party shall be entitled to their reasonable attorney’s fees and costs incurred in having to enforce the terms of this agreement, including pre- and post-suit, and all appellate levels.
- I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Florida, and that this Waiver shall be governed by and interpreted in accordance with the laws of the state of Florida. I agree that in the event that any clause or provision of this Waiver shall invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
I have read this entire Release of Liability Document. I understand it is a promise not to sue and to release The Little Farm for all claims. I have made a free, voluntary, intentional, and deliberate choice to enter onto the farm property and agree to this Release and Waiver.
Liability Release for Pony Rides
The purchaser will be assuming responsibility for riders and attendees.
Release and waiver of liability, assumption of risk, and indemnity agreement – read this agreement carefully. By purchasing this ticket, you and your child are giving up certain legal rights, including the right to sue or recover damages in case of injury, death or property damages, for any reason, including but not limited to, the negligence of The Little Farm, Inc., employees and helpers (“the releasees”).
In consideration for allowing me, minor children I am responsible for, and/or guests to participate in pony rides and petting zoo activities. I hereby:
Acknowledge that a horse, pony and/or animals may, without warning or any apparent cause, buck, stumble, fall, rear, bite, kick, run, make unpredictable movements, spook, jump obstacles, step on a person’s feet, push or shove a person, saddles or bridles may loosen or break – all of which may cause the rider to fall or be jolted, resulting in serious injury or death.
Acknowledge that horseback riding is an inherently dangerous activity and involves risks that may cause serious injury and in some cases death, because of the unpredictable nature of horses/ponies, regardless of their training and past performance.
Voluntarily assume the risk and danger of injury or death inherent while engaging in any and all activities involving the animals associated with The Little Farm, Inc.
Release, discharge and promise not to sue any individual associated with The Little Farm, Inc., for any loss, liability, damages caused by any employees or animals.
The purchaser expressly agrees that the foregoing release and waiver of liability, assumption of risk, and indemnity agreement is governed by the State of Florida and is intended to be as broad and inclusive as is permitted by Florida statute 773, and that in the event any portion of this Agreement is determined to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the balance of the Agreement shall not be affected or impaired in any way and shall continue in full legal force and effect.
Acknowledge that this document is a contract and agree that if a lawsuit is filed against The Little Farm, Inc. or its owner, agents, employees, or guides for any injury or damage in breach of this contract, the Undersigned will pay all attorney’s fees and costs incurred by The Little Farm, Inc. in defending such an action.
If the person who is to enter into this Agreement is less than eighteen (18) years of age, his/her parent or guardian must read this Agreement and sign below.
I have read this entire Release of Liability Document. I understand it is a promise not to sue and to release The Little Farm, Inc., It’s owners, employees and agents for all claims. I have concluded that the risks involved and the release and waiver of liability is worth the risk.
